These Terms of Service ("Terms") govern your access to and use of our website at progreengardeners.com (the "Site") and any related services, including landscaping, irrigation, and maintenance services (collectively, the "Services"). By accessing the Site or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.

1. Use of Services

• Eligibility: You must be at least 18 years old to use the Services. By using the Services, you represent that you meet this requirement.
• Permitted Use: The Services are for personal, non-commercial use only. You agree not to misuse the Site or Services, including by interfering with their operation or engaging in unauthorized access.

2. Payments and Fees

• Pricing: All prices are estimates and subject to change based on site inspection. Final costs will be provided in writing before work begins.
• Payment Terms: Payment is due upon completion of services via cash, check, or electronic transfer. Late payments may incur a 1.5% monthly fee.
• Taxes: You are responsible for any applicable sales taxes.

3. Cancellation and Refunds

• Cancellation Policy: Services may be canceled up to 24 hours before the scheduled time without penalty. Cancellations within 24 hours may incur a 50% fee. No-shows will be charged in full.
• Refunds: Refunds are at our discretion and limited to services not performed. We do not refund for completed work.

4. Intellectual Property

All content on the Site, including designs, logos, and images, is owned by ProGreen Gardeners or its licensors. You may not reproduce or distribute it without written permission.

5. Limitation of Liability

• Disclaimer: Services are provided "as is." We disclaim all warranties, express or implied, including for fitness for a particular purpose.
• Liability Cap: Our total liability shall not exceed the amount paid for the specific service causing the claim. We are not liable for indirect, consequential, or incidental damages.
• Risk Assumption: You assume all risks related to property damage or personal injury from our Services, except as required by law.

6. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts of San Diego County, California.

7. Changes to Terms

We may update these Terms at any time. Continued use of the Site or Services after changes constitutes acceptance.
