1. ACCEPTANCE OF TERMS

By requesting a quote, scheduling a service, or engaging ProGreen Gardeners & Landscaping («ProGreen,» «we,» «us,» or «our») in any capacity, you («Client,» «you,» or «your») agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.


2. SERVICES

ProGreen Gardeners & Landscaping provides residential landscaping, irrigation, and related outdoor services throughout San Diego County, California, including but not limited to:

  • Sprinkler & Irrigation Repair and Installation
  • Drip Irrigation Systems
  • Sprinkler Head & Valve Replacement
  • Irrigation Leak Detection
  • Synthetic Turf Installation
  • Sod Installation
  • Lawn Care & Maintenance
  • Weed Control
  • Yard Cleanup
  • Tree & Shrub Trimming
  • Landscape Design
  • Concrete & Pavers
  • LED Landscape Lighting

Services are subject to availability and may be declined at our discretion. We reserve the right to modify or discontinue any service at any time without prior notice.


3. ESTIMATES & PRICING

3.1 Free Estimates. ProGreen provides free, no-obligation estimates for all services. Estimates are based on information provided by the Client and a visual inspection of the property.

3.2 Estimate Validity. All written estimates are valid for 30 days from the date of issuance. After 30 days, pricing may be subject to change.

3.3 Changes in Scope. If additional work is discovered during the project that was not included in the original estimate, ProGreen will notify the Client before proceeding. Additional charges will apply for any work outside the original scope.

3.4 Final Invoice. The final invoice will reflect the approved estimate plus any agreed-upon additional work. No hidden fees will be added without prior Client approval.


4. PAYMENT TERMS

4.1 Accepted Payment Methods. ProGreen accepts cash, check, credit/debit card, Zelle, Venmo, and PayPal.

4.2 Payment Due Date. Payment is due upon completion of services unless otherwise agreed in writing. For larger projects, a deposit may be required before work begins.

4.3 Late Payments. Invoices not paid within 15 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance.

4.4 Returned Checks. A fee of $35 will be charged for any returned or bounced checks, in addition to any bank charges incurred.

4.5 Withholding Payment. Withholding payment for reasons not communicated to ProGreen prior to or during service completion is not permitted. Any billing disputes must be raised within 5 business days of invoice receipt.


5. SCHEDULING & CANCELLATIONS

5.1 Scheduling. Appointments are scheduled based on availability. ProGreen will make every reasonable effort to arrive within the agreed service window.

5.2 Cancellations by Client. Cancellations made less than 24 hours before a scheduled appointment may be subject to a cancellation fee of up to $50.

5.3 Cancellations by ProGreen. ProGreen reserves the right to reschedule or cancel appointments due to weather conditions, equipment issues, or other circumstances beyond our control. We will notify the Client as soon as possible and reschedule at the earliest available date.

5.4 Recurring Services. Monthly maintenance contracts may be cancelled with 15 days written notice. Fees for services already rendered are non-refundable.


6. CLIENT RESPONSIBILITIES

6.1 Property Access. The Client agrees to provide safe and unobstructed access to the work area on the scheduled service date. This includes removing vehicles, securing pets, and ensuring gate access.

6.2 Accurate Information. The Client is responsible for providing accurate information about the property, including known underground utilities, irrigation systems, or any conditions that may affect service delivery.

6.3 Underground Utilities. ProGreen is not responsible for damage to underground utilities, pipes, cables, or systems that are not marked or disclosed prior to service. It is the Client’s responsibility to contact the appropriate utility notification service (811 — Call Before You Dig) before any digging or excavation work is performed.

6.4 Permits. The Client is responsible for obtaining any required permits or HOA approvals prior to project commencement, unless otherwise agreed in writing.


7. WARRANTY & GUARANTEE

7.1 Workmanship. ProGreen stands behind the quality of its work. If a service is not completed to a satisfactory standard, the Client must notify ProGreen within 7 days of service completion. ProGreen will return to correct the issue at no additional charge.

7.2 Materials & Products. Warranties on materials, plants, sod, turf, and equipment are subject to the manufacturer’s or supplier’s warranty terms. ProGreen does not independently warranty third-party materials beyond the manufacturer’s coverage.

7.3 Plant & Sod Survival. ProGreen does not guarantee the survival of plants, sod, or natural turf after installation. Survival depends on proper Client maintenance, watering schedules, and environmental conditions beyond our control.

7.4 Irrigation Systems. Repaired or installed irrigation systems are warranted against defects in workmanship for 30 days from the date of service. This warranty does not cover damage caused by third parties, freezing, water pressure irregularities, or client modifications.


8. LIMITATION OF LIABILITY

8.1 ProGreen’s total liability for any claim arising from services rendered shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.

8.2 ProGreen shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, loss of revenue, or damage to property not directly caused by our negligence.

8.3 ProGreen carries full General Liability Insurance. In the event of property damage directly caused by our negligence, the Client must notify ProGreen in writing within 48 hours of the incident.


9. INSURANCE & LICENSING

ProGreen Gardeners & Landscaping holds an active California State License Board (CSLB) contractor’s license and carries General Liability Insurance on all projects. License details are available upon request and can be verified at www.cslb.ca.gov.


10. PHOTOGRAPHS & MARKETING

ProGreen reserves the right to photograph completed projects for use in marketing materials, including our website, social media, and advertising. No personally identifiable information (such as the Client’s name or address) will be published without explicit written consent.


11. PRIVACY

Any personal information collected during the course of business (name, address, phone number, email) is used solely for service delivery and communication purposes. ProGreen does not sell or share personal information with third parties, except as required by law. For full details, see our Privacy Policy at progreengardeners.com/privacy.


12. GOVERNING LAW & DISPUTES

12.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California.

12.2 Any dispute arising out of or related to these terms or services provided by ProGreen shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in San Diego County, California, in accordance with the rules of the American Arbitration Association.

12.3 The prevailing party in any dispute shall be entitled to recover reasonable attorney’s fees and costs.


13. MODIFICATIONS TO TERMS

ProGreen reserves the right to update or modify these Terms and Conditions at any time. Updated terms will be posted on our website at progreengardeners.com/terms. Continued use of our services after any such changes constitutes your acceptance of the updated terms.
